1. Assumption of Risk
I acknowledge that I am aware of the inherent risks involved in participating in this camp or course. I understand these risks include but are not limited to: hazards associated with the ocean, irregular terrain, dehydration, hypothermia, physical exhaustion, vehicle traffic, and lack of immediate medical access. I certify that I am physically fit, have sufficiently trained for this event, and have not been advised otherwise by a qualified medical professional. I voluntarily assume all risks associated with my participation.
2. Waiver and Release of Liability
In consideration of being allowed to participate, I hereby release, waive, discharge, and covenant not to sue the Organizers, Sponsors, Volunteer Groups, Medical Personnel, Landowners, Local Authorities, and their respective agents, directors, and employees (collectively strictly referred to as the “Releasees”) from any and all liability. This release covers claims for personal injury, property damage, disability, death, or theft of property which may hereafter occur to me, whether caused by the negligence of the Releasees or otherwise.
3. Indemnification
I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in the event, or strictly arising out of my own negligence or wilful misconduct.
4. Medical Consent
In the event of an injury, accident, or illness during the event, I consent to receive medical treatment deemed advisable by on-site medical personnel or that I will be taken to either Hermanus Mediclinic or the Hermanus Provincial Hospital to receive medical treatment. I understand and agree that I am solely responsible for all costs related to such medical treatment, medical transportation, and evacuation.
5. Media
I grant the Organizers the irrevocable right to use my name, voice, likeness, image, and video recordings from the event for any legitimate purpose, including marketing without compensation or further permission.
6. Cancellation of event by organisers
I agree to abide by all rules and regulations established by the Organisers. I understand that the Organisers reserve the right to cancel the event due to “Force Majeure” (e.g., severe weather, acts of God) or safety concerns. In such cases, I accept that entry fees are non-refundable and non-transferable.
7. Acknowledgment
By ticking the box below (or signing), I acknowledge that I have read and understood this waiver. I understand that I am giving up substantial legal rights, including the right to sue.
